Please read this agreement carefully. By installing, accessing, or using the MyProtektor application or website, you confirm that you accept this End User Licence Agreement and agree to comply with its terms. If you do not agree, you must not use the software.

1. Agreement to Terms
This End User Licence Agreement ("Agreement" or "EULA") is a legally binding contract between you ("User", "you", or "your") and MyProtektor, operated by Mike Roth, Founder, Michael-Gaismayr-Strasse 52b, 6900 Bregenz, Austria, European Union ("MyProtektor", "we", "us", or "our"). This Agreement governs your access to and use of the MyProtektor software, including the mobile application available on the Apple App Store and Google Play Store, the web application at www.myprotektor.co.za, and any associated services, updates, and documentation (collectively, the "Software").
By creating an account, installing the mobile application, or accessing the web application, you acknowledge that you have read, understood, and agree to be bound by this EULA. If you are accepting this EULA on behalf of an organisation, you represent and warrant that you have the authority to bind that organisation to these terms.
2. Licence Grant
Subject to your compliance with this Agreement, MyProtektor grants you a limited, non-exclusive, non-transferable, revocable licence to:
- Download, install, and use the mobile application on devices that you own or control, solely for your internal business or personal use in connection with the MyProtektor platform.
- Access and use the web application through a supported web browser for the same purposes.
This licence does not grant you any ownership interest in the Software. All rights not expressly granted in this Agreement are reserved by MyProtektor.
3. Subscription Activation
Access to the full functionality of the Software requires an active paid subscription. Different subscription tiers (Standard Plan, Professional Plan, Custom Plan, or LiteClient Plan) provide access to different features and capacity levels as described on the MyProtektor pricing page.
Your subscription is activated upon successful payment and continues for the duration of the billing period you have selected (monthly or annual). Certain features may be available during a free trial period as specified at the time of sign-up. Upon expiry of a trial or lapse of a paid subscription, access to premium features will be restricted until payment is restored.
MyProtektor reserves the right to modify subscription tiers, pricing, and feature availability. Material changes will be communicated to affected subscribers with reasonable advance notice.
4. Permitted Use
You may use the Software solely for lawful purposes that are consistent with the intended functionality of the MyProtektor platform. Permitted uses include:
- Managing security operations, including incident reporting, guard tracking, and patrol management.
- Sending and receiving panic alerts and emergency notifications within your organisation.
- Generating reports and reviewing analytics related to your organisation's security operations.
- Managing user accounts, roles, and permissions within your organisation.
- Accessing the LiteClient portal for personal safety features, including the incident map and panic button.
For clarity, this software is designed and intended to operate as an information technology tool. It is not intended to provide security services as defined in the PSIRA Act or any equivalent legislation. You acknowledge that all security operations conducted using this software are performed by your independently licensed security organisation.
5. Restrictions on Use
You agree that you will not, and will not permit any third party to:
- Copy, modify, adapt, translate, or create derivative works based on the Software or any part thereof.
- Reverse engineer, disassemble, decompile, or otherwise attempt to extract the source code of the Software, except to the extent that such activity is expressly permitted by applicable law.
- Sublicence, lease, rent, loan, sell, distribute, or otherwise transfer the Software or your access credentials to any third party.
- Use the Software to develop a competing product or service, or for the purpose of benchmarking or competitive analysis.
- Remove, alter, or obscure any proprietary notices, labels, or markings on or within the Software.
- Use the Software in any manner that violates applicable local, national, or international laws or regulations.
- Attempt to gain unauthorised access to any part of the Software, its servers, or connected systems.
- Use the Software to transmit malicious code, viruses, or any harmful content.
- Use automated tools, bots, scrapers, or scripts to access or interact with the Software, unless expressly authorised in writing by MyProtektor.
- Abuse the panic alert system by sending false or non-emergency alerts.
6. Intellectual Property
The Software, including all code, designs, graphics, text, user interfaces, trademarks, logos, and documentation, is the exclusive property of MyProtektor or its licensors and is protected by South African and international copyright, trademark, and intellectual property laws.
The MyProtektor name, logo, and associated branding are trademarks of MyProtektor. You may not use these trademarks without prior written consent, except as necessary to identify the Software in the ordinary course of use.
Any content you submit to the Platform (such as incident reports, photographs, and comments) remains your property. However, by submitting content, you grant MyProtektor a non-exclusive, worldwide, royalty-free licence to use, store, display, and process that content as necessary to provide and improve the Software.
7. Privacy and Data Collection
Your use of the Software is also governed by our Privacy Policy and Data Protection Notice, which describe how we collect, use, store, and protect your personal information. By using the Software, you consent to the data practices described in those documents.
The Software collects certain data necessary for its operation, including (but not limited to) GPS location data, device information, usage analytics, and push notification tokens. Location data collection occurs during active shifts and when panic alerts are triggered. Please refer to the Privacy Policy for full details.
8. Software Updates and Maintenance
MyProtektor may from time to time release updates, patches, bug fixes, or new versions of the Software. These updates may be delivered automatically through the applicable app store or web deployment process.
- Automatic updates: You agree that MyProtektor may deliver updates automatically. Some updates may be required for continued use of the Software.
- Feature changes: Updates may add, modify, or remove features. MyProtektor will make reasonable efforts to communicate significant changes in advance.
- Compatibility: MyProtektor does not guarantee that the Software will remain compatible with all devices, operating systems, or browser versions. It is your responsibility to maintain a compatible device and environment.
MyProtektor may schedule maintenance windows during which the Software is temporarily unavailable. Where possible, scheduled maintenance will be announced in advance.
9. Support and Warranty Disclaimer
MyProtektor provides customer support for the Software through the contact channels listed on the website. Response times may vary depending on the nature of the query and the user's subscription tier.
THE SOFTWARE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MYPROTEKTOR DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
MyProtektor does not warrant that the Software will be error-free, uninterrupted, secure, or free of viruses or other harmful components. MyProtektor does not warrant that the results obtained from the use of the Software will be accurate or reliable.
10. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY THE LAWS OF SOUTH AFRICA:
- MyProtektor's total aggregate liability for all claims arising out of or in connection with this Agreement or the use of the Software shall not exceed the lesser of (a) the total fees paid by you to MyProtektor in the twelve (12) months immediately preceding the event giving rise to the claim, or (b) fifty thousand South African Rand (R50,000).
- MyProtektor shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages, including loss of profits, data, business opportunities, or goodwill, arising from the use or inability to use the Software.
- MyProtektor shall not be liable for any failure or delay in performance caused by circumstances beyond its reasonable control, including but not limited to natural disasters, power failures, internet disruptions, third-party service outages, or government actions.
Nothing in this Agreement limits or excludes liability that cannot lawfully be limited or excluded.
11. Termination
11.1 Termination by You
You may terminate this Agreement at any time by deleting your account through the account settings page and removing the mobile application from your devices. Cancellation of your subscription does not automatically delete your account; you must explicitly request account deletion if you wish your data to be removed.
11.2 Termination by MyProtektor
MyProtektor may suspend or terminate your licence and access to the Software at any time, with or without notice, if:
- You breach any provision of this Agreement.
- Your subscription payment fails and is not remedied within a reasonable grace period.
- You engage in conduct that MyProtektor reasonably determines to be harmful to the Platform, other users, or MyProtektor's reputation.
- MyProtektor decides to discontinue the Software or any part of it.
11.3 Effect of Termination
Upon termination of this Agreement:
- Your licence to use the Software is immediately revoked.
- You must cease all use of the Software and delete any copies of the mobile application from your devices.
- MyProtektor may delete your account data in accordance with the data retention periods described in our Data Protection Notice.
- Sections of this Agreement that by their nature should survive termination (including Sections 6, 9, 10, and 14) shall continue in full force and effect.
12. Export Compliance
You agree to comply with all applicable export control laws and regulations, including those of South Africa and any other relevant jurisdiction. You shall not export, re-export, or transfer the Software or any underlying technology to any country, entity, or individual that is subject to applicable trade sanctions or export restrictions.
13. Third-Party Components
The Software incorporates certain open-source software components and third-party libraries. These components are subject to their own licence terms, which may differ from this Agreement. A list of significant open-source components used in the Software and their respective licences is available upon request.
To the extent that any open-source licence requires that MyProtektor grant rights to the open-source component that are broader than the rights granted in this EULA, those broader rights shall govern solely with respect to that open-source component.
14. Governing Law and Dispute Resolution
This Agreement is governed by and construed in accordance with the laws of the Republic of South Africa, without regard to its conflict of laws principles.
Before initiating formal legal proceedings, you agree to first attempt to resolve any dispute informally by contacting us in writing. We will endeavour to reach a mutually satisfactory resolution within thirty (30) days. If informal resolution is unsuccessful, either party may refer the dispute to mediation administered by a mutually agreed mediator in South Africa, with costs shared equally. If mediation does not resolve the dispute within sixty (60) days, either party may pursue the matter through the courts of the Republic of South Africa.
If any provision of this Agreement is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary so that this Agreement shall otherwise remain in full force and effect.
15. Entire Agreement
This EULA, together with the Terms of Service, Privacy Policy, Acceptable Use Policy, and any subscription-specific terms presented at the time of purchase, constitutes the entire agreement between you and MyProtektor with respect to the subject matter hereof and supersedes all prior or contemporaneous communications, representations, or agreements, whether oral or written.
No amendment to this Agreement shall be effective unless made in writing and published by MyProtektor through the Platform. MyProtektor's failure to enforce any right or provision of this Agreement shall not constitute a waiver of that right or provision.

Service Limitations
MyProtektor is a software platform for the coordination and documentation of security-related operations. It is not a provider of security, armed response, emergency, or dispatch services, and no feature of the platform shall be construed as a guarantee of intervention, availability, or response time. In any emergency situation, the responsible public emergency services must be contacted directly.
